By accessing or using Pewisty ("Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.
IMPORTANT: These Terms contain an arbitration agreement and class action waiver in Section 13. By using Pewisty, you agree to resolve disputes through binding arbitration rather than in court.
1.1 EligibilityYou must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to use Pewisty. By using the Platform, you represent and warrant that you meet these age requirements.1.2 Account Registration
  • You must register using valid Google, Apple, or Microsoft credentials
  • You must provide accurate, current, and complete information
  • You are responsible for maintaining the security of your account
  • You may not share your account credentials with others
  • One person or entity per account; multiple accounts are prohibited
1.3 Account VerificationTo maintain platform security and verify legitimate users, all users must:
  • Complete social login authentication (Google/Apple/Microsoft)
  • Provide a valid payment method (credit or debit card)
  • Authorize a temporary verification hold (typically $0.50-$1.00 USD or local equivalent)
IMPORTANT: The verification hold is automatically released within 24-48 hours and is never charged. This verification helps prevent fraudulent accounts and maintains a trusted environment for all users.

2.1 What Pewisty ProvidesPewisty is a networking and connection platform that:
  • Enables Service Providers (freelancers) to create profiles and list services
  • Allows Service Seekers (clients) to find and connect with Service Providers
  • Provides secure messaging and communication tools
  • Maintains records of platform communications for digital services
2.2 What Pewisty Does NOT ProvidePewisty does NOT:
  • Process, handle, or guarantee payments between users
  • Act as employer, agent, or representative of any user
  • Guarantee the quality, safety, legality, or delivery of services
  • Verify credentials, qualifications, licenses, or work quality of Service Providers
  • Mediate, arbitrate, or resolve disputes between users (we may provide assistance and documentation only)
  • Assume liability for user conduct, service delivery, or payment disputes
  • Provide employment, staffing, recruiting, or referral services
  • Supervise, direct, or control the work of any Service Provider
  • Recommend, endorse, vouch for, or certify any user or service
CRITICAL UNDERSTANDING: Pewisty acts solely as a third-party platform that enables introductions between Service Providers and Service Seekers. All service agreements and payment transactions occur directly between users. Pewisty facilitates connections only.
2.3 Independent Evaluation RequiredYOU ACKNOWLEDGE AND AGREE THAT:
  • You are solely responsible for evaluating other users
  • You must verify credentials, licenses, qualifications, and suitability independently
  • You assume all risks associated with user interactions
  • Platform profiles, reviews, and ratings do NOT constitute endorsement by Pewisty
  • Pewisty has no control over user conduct on or off the platform

3.1 Service Providers (Freelancers)SUBSCRIPTION REQUIREMENTS:Trial Period:
  • Free 30-day trial period with full platform access
  • No charges during trial; verification hold is NOT a charge
  • Full access to create profiles, list services, and connect with clients
Paid Subscription:
  • Monthly subscription fee of [SUBSCRIPTION_AMOUNT] after trial ends
  • Automatic renewal unless cancelled before renewal date
  • No refunds for partial months or cancelled subscriptions
  • Zero commission on earnings - you keep 100% of what clients pay you
  • Payment due regardless of platform usage or client acquisition
You confirm that all information provided is genuine and not misleading, exaggerated, or false.Documents and Credentials:If you upload or present licenses, certificates, diplomas, company documents, or professional qualifications:
  • You confirm all documents are genuine and legally valid
  • Any fake, altered, or misleading document places full legal responsibility on you
  • Pewisty does not verify or certify documents and bears NO responsibility for their authenticity
Service Delivery:
  • Perform services professionally and responsibly
  • Communicate clearly and honestly with clients
  • Complete agreed work to the best of your ability
  • Deliver services as promised in your listings and agreements
  • Meet deadlines and commitments made to clients
  • Handle all aspects of service delivery independently
However, Pewisty does not guarantee or judge service quality. Clients evaluate your work independently and at their own discretion.Payment Collection:
  • All pricing, payment terms, and methods are agreed directly with clients
  • You are solely responsible for collecting payment from clients
  • Pewisty is NOT involved in payments between you and clients
  • Pewisty does NOT mediate payment disputes
  • Late payment, underpayment, or non-payment is not Pewisty's responsibility
  • You bear all risks related to payment collection
Communication and Conduct:
  • Communicate respectfully and professionally with all users
  • Respond to inquiries in a timely manner
  • Avoid harassment, threats, or abusive behavior
  • Do not pressure clients into payment or agreements
  • Maintain professional standards in all interactions
Legal and Tax Compliance:
  • You are an independent service provider, NOT an employee of Pewisty
  • You handle your own taxes, permits, and legal obligations
  • You are responsible for all regulatory compliance in your jurisdiction
  • You maintain appropriate business licenses and insurance as required
  • You report income appropriately according to local tax laws
PROHIBITED ACTIVITIES FOR SERVICE PROVIDERS:You must NOT:
  • Misrepresent identity, qualifications, or services
  • Use fake, altered, or misleading documents or credentials
  • Engage in fraud, scams, or deceptive practices
  • Create multiple or fake accounts
  • Offer illegal services or services violating third-party terms
  • Use the platform for any illegal purposes
  • Request off-platform payment to circumvent subscription fees before establishing a working relationship
  • Use fake reviews or manipulate ratings
  • Harass, threaten, or defraud clients
  • Attempt to deceive clients in any manner
Any malicious, harmful, or unethical behavior may result in account suspension or permanent termination.NO GUARANTEES FROM PEWISTY:Pewisty does NOT provide:
  • References, endorsements, or guarantees of your services
  • Certification or validation of your skills or credentials
  • Guarantees of work, income, or client acquisition
  • Employment or employee benefits
  • Legal representation or protection
Your profile and reviews do NOT represent certification by Pewisty. Clients decide independently whether to work with you.3.2 Service Seekers (Clients)FREE ACCESS:
  • No subscription fees, transaction fees, or platform charges
  • Full access to search, browse, and contact Service Providers
  • Account verification required (payment method on file)
  • Completely free to use - you only pay Service Providers directly for their work
YOUR RESPONSIBILITIES:Finding and Evaluating Service Providers:
  • Conduct independent research and due diligence
  • Verify Service Provider credentials, licenses, and qualifications
  • Review portfolios, ratings, and client testimonials carefully
  • Assess suitability for your specific project needs
  • Make informed decisions about which Service Providers to engage
Project Communication:
  • Provide clear, accurate, and complete project requirements
  • Communicate expectations, deadlines, and deliverables clearly
  • Respond to Service Provider questions in a timely manner
  • Document important agreements and scope changes
  • Maintain professional communication standards
Payment Obligations:
  • Pay Service Providers directly according to agreed terms
  • Negotiate and agree on payment terms, methods, and schedules directly
  • Honor payment commitments and agreements made
  • Resolve payment disputes directly with Service Providers
  • Use secure and trackable payment methods
You acknowledge that:
  • Pewisty does NOT process, guarantee, or mediate payments
  • All payment arrangements are between you and Service Providers
  • Payment disputes must be resolved directly with Service Providers
  • Pewisty bears no responsibility for payment-related issues
Professional Conduct:
  • Treat Service Providers professionally and respectfully
  • Provide constructive feedback when appropriate
  • Address concerns directly and professionally
  • Do not make unreasonable demands or requests
  • Respect Service Providers' time and expertise
Legal Compliance:
  • Request only legal services that comply with applicable laws
  • Do not use the platform for illegal or unauthorized purposes
  • Comply with all applicable laws and regulations in your jurisdiction
  • Ensure your project requirements are legal and appropriate
PROHIBITED ACTIVITIES FOR SERVICE SEEKERS:You must NOT:
  • Request illegal services or services violating third-party terms
  • Engage in fraud, scams, or deceptive practices
  • Harass, threaten, or abuse Service Providers
  • Post fake reviews or manipulate the rating system
  • Conduct payment disputes in bad faith
  • Attempt to use the platform for illegal purposes
  • Refuse payment without legitimate cause
  • Make false claims about Service Providers
  • Misrepresent project requirements or scope

4.1 Direct Relationships Between UsersALL SERVICE AGREEMENTS, CONTRACTS, AND PAYMENT ARRANGEMENTS ARE MADE DIRECTLY BETWEEN SERVICE PROVIDERS AND SERVICE SEEKERS.Pewisty is NOT a party to these agreements and assumes NO responsibility for:
  • Terms, pricing, scope, or specifications of services
  • Quality, timeliness, or delivery of work
  • Payment processing, collection, disputes, or failures
  • Contractual obligations or performance between parties
  • Outcomes, results, or satisfaction with services rendered
  • Warranties, guarantees, or representations made by users
  • Intellectual property ownership or licensing
  • Liability for damages, losses, or injuries arising from services
4.2 No Guarantee of OutcomesPEWISTY DOES NOT GUARANTEE:
  • Service quality, completion, or satisfaction
  • Timely delivery or professional performance
  • Payment by clients or income for Service Providers
  • Accuracy of user information or credentials
  • Success of projects or business relationships
  • Resolution of disputes or conflicts
Good or bad service outcomes are part of an open marketplace model and remain the sole responsibility of the parties involved.4.3 Payment ArrangementsCRITICAL: Pewisty is NOT involved in payments between users.
  • Service Providers and Service Seekers negotiate and agree on payment terms directly
  • Payment methods (bank transfer, PayPal, digital wallets, cash, etc.) are determined between parties
  • Pewisty does not process, hold, facilitate, or manage payments
  • All payment disputes, including non-payment, chargebacks, late payments, overpayment, or underpayment must be resolved directly between parties
  • Users are responsible for their own payment security and record-keeping
  • Pewisty accepts NO liability for any financial loss or payment-related issues
Unlike platforms that require on-platform payments, Pewisty's model places all financial responsibility on users themselves.4.4 Communication and Documentation
  • Initial project discussions should occur through Pewisty's messaging system
  • Platform messaging creates a record that may assist with dispute reference (for digital services only)
  • After establishing a working relationship, users may exchange direct contact information
  • Important agreements and scope changes should be documented through platform messaging when possible
  • Pewisty maintains conversation records but does not guarantee their admissibility or use in legal proceedings
Communication tools provided are NOT confidential or legally binding frameworks for contracts. Users should agree to contracts, scopes of work, and deliverables independently and in writing outside the Platform for legal enforceability.4.5 Disputes Between UsersPEWISTY IS NOT RESPONSIBLE FOR DISPUTES BETWEEN SERVICE PROVIDERS AND SERVICE SEEKERS.This includes but is not limited to disputes regarding:
  • Payment issues (non-payment, late payment, disputed amounts)
  • Service quality or performance
  • Missed deadlines or incomplete work
  • Scope changes or misunderstandings
  • Intellectual property ownership
  • Contractual disagreements
  • Professional misconduct
While we may provide communication records and dispute assistance for digital services, we do NOT:
  • Mediate or arbitrate between users
  • Make determinations about who is right or wrong
  • Force payment or refunds
  • Provide payment protection or escrow services
  • Offer binding dispute resolution services
  • Guarantee any particular outcome
Users must resolve disputes directly with each other and may seek independent legal advice or pursue legal remedies as appropriate.

5.1 Service Provider SubscriptionTrial period:
  • 30-day free trial with full platform access
  • No charges during trial period
  • Verification hold (typically $0.50-$1.00) is NOT a charge and is automatically released
Paid Subscription:
  • Monthly subscription fee: [SUBSCRIPTION_AMOUNT]
  • Billing begins immediately after trial period ends
  • Automatic monthly renewal on the same date each month
  • Payment methods accepted: Credit card, debit card

Billing Terms:
  • Subscription fees are non-refundable under any circumstances
  • No refunds for partial months, early cancellation, or dissatisfaction
  • No refunds if account is suspended or terminated for violations
  • Fees may be adjusted with 30 days' notice
  • Failure to pay results in account suspension and eventual termination
Commission Structure:
  • Zero commission on your earnings
  • You keep 100% of what clients pay you
  • No transaction fees or percentage-based charges
  • Only the flat monthly subscription fee applies
5.2 Service Seeker Access
  • Completely free - no fees of any kind
  • No subscription fees
  • No transaction fees or commissions
  • No hidden charges
  • Payment verification required but no actual charges to your payment method
5.3 Payment AuthorizationBy providing payment information, you authorize Pewisty to:
  • Perform verification holds on payment methods (automatically released)
  • Charge applicable subscription fees (Service Providers only)
  • Automatically renew subscriptions until cancelled
  • Update payment methods with information provided by payment processors or issuing banks
  • Charge any outstanding fees or amounts owed
5.4 Failed PaymentsIf subscription payment fails:
  • We will attempt to charge your payment method multiple times
  • You will receive email notifications of payment failure
  • Account access may be restricted after [7 days] of non-payment
  • Account may be suspended after [14 days] of non-payment
  • Account may be terminated after [30 days] of non-payment
  • You remain responsible for all unpaid fees
5.5 Cancellation and RefundsService Providers may:
  • Cancel subscription at any time through account settings
  • Cancellation takes effect at the end of current billing period
  • Access continues until the end of paid period
  • No refunds for unused time in current billing period
  • Profile becomes inactive after cancellation (data preserved for [90 days])
  • Reactivate by resuming subscription payments
No Refund Exceptions:
  • Subscriptions are non-refundable under ANY circumstances, including:
    • Account suspension or termination for Terms violations
    • Dissatisfaction with platform or results
    • Lack of client acquisition or income
    • Technical issues or platform downtime
    • Change of mind or business circumstances
    • Duplicate payments or billing errors (credit issued for future use only)
5.6 TaxesAll fees are exclusive of applicable taxes. You are responsible for:
  • Paying all applicable sales, use, value-added (VAT), goods and services (GST), or similar taxes
  • Providing valid tax exemption certificates if applicable
  • Accurately reporting income for tax purposes
Pewisty will charge applicable taxes based on your billing address where required by law.

6.1 User Content OwnershipUsers retain ownership of content they post, including:
  • Profile information and descriptions
  • Work samples and portfolio items
  • Service listings and pricing
  • Messages and communications
  • Reviews and testimonials
6.2 License to PewistyBy posting content on Pewisty, you grant us a worldwide, non-exclusive, royalty-free, transferable license to:
  • Display and distribute your content on the platform
  • Use content for marketing and promotional purposes
  • Reproduce content for platform operation and improvement
  • Create derivative works for platform functionality
  • Sublicense to service providers assisting with platform operation
This license continues even after you delete content or close your account, to the extent we have legitimate need to retain it (backups, legal compliance, dispute resolution).6.3 Content Representations and WarrantiesBy posting content, you represent and warrant that:
  • You own or have rights to all content posted
  • Content does not violate intellectual property rights of others
  • Content does not violate any laws or third-party rights
  • Content is accurate and not misleading
  • You have obtained all necessary permissions, releases, and licenses
You are solely responsible for all content you post and any consequences of posting it.6.4 Work Product OwnershipOwnership of work product created through service engagements is determined directly between Service Provider and Service Seeker.Pewisty:
  • Has no involvement in work product ownership or intellectual property transfer
  • Is not responsible for intellectual property disputes between users
  • Does not claim any rights to work product created through the platform
  • Recommends users establish clear ownership terms in their direct agreements
Users should address licensing, ownership, usage rights, and intellectual property transfer in separate written agreements.6.5 Platform Intellectual PropertyAll Pewisty branding, logos, design elements, features, functionality, software, and content are owned by Pewisty and protected by copyright, trademark, patent, and other intellectual property laws.You may NOT:
  • Copy, modify, or create derivative works of platform elements
  • Use Pewisty intellectual property without written permission
  • Reverse engineer or decompile platform software
  • Remove or alter proprietary notices or labels
  • Use our trademarks, logos, or branding without authorization
6.6 Copyright Infringement ClaimsWe respect intellectual property rights. If you believe content on Pewisty infringes your copyright, contact us at legal@pewisty.com with:
  • Identification of copyrighted work claimed to be infringed
  • Identification of allegedly infringing material and its location
  • Your contact information
  • Statement of good faith belief that use is not authorized
  • Statement that information is accurate and you are authorized to act
  • Your physical or electronic signature
We will investigate valid claims and may remove infringing content.

Users may not engage in or post content involving:7.1 Illegal or Harmful Activities
  • Illegal services or activities under applicable law
  • Fraud, scams, or intentionally deceptive practices
  • Money laundering or financial crimes
  • Identity theft or impersonation
  • Hacking, phishing, or malware distribution
  • Violations of third-party terms of service
  • Infringement of intellectual property rights
  • Harassment, stalking, threats, or abusive behavior
  • Discrimination based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or other protected characteristics
  • Doxing or unauthorized disclosure of private information
  • Incitement to violence or illegal activity
7.2 Platform Misuse
  • Creating multiple accounts or fake accounts
  • Sharing login credentials or selling accounts
  • Using automated tools, bots, scrapers, or data mining tools
  • Manipulating reviews, ratings, or search rankings
  • Posting spam or unsolicited commercial messages
  • Attempting to circumvent platform fees, verification, or restrictions
  • Reverse engineering, decompiling, or compromising platform security
  • Interfering with platform operation or other users' access
  • Accessing areas of the platform you're not authorized to access
  • Collecting user information without consent
  • Uploading viruses or malicious code
7.3 Prohibited ServicesThe following services are strictly prohibited:Academic Dishonesty:
  • Writing papers, essays, or assignments for students
  • Taking exams or completing coursework for others
  • Providing answers to academic assignments
Fraudulent Services:
  • Fake documents, IDs, credentials, or certificates
  • Fake reviews, testimonials, or social media engagement
  • Identity documents or government credentials
  • Diploma mills or fraudulent educational credentials
Adult and Explicit Content:
  • Adult services or sexually explicit content
  • Escort services or prostitution
  • Pornographic content creation or distribution
Unregulated Professional Services:
  • Medical advice or diagnosis without proper licensing
  • Legal advice without proper licensing or bar membership
  • Financial advice without proper licensing and compliance
  • Pharmaceutical sales or controlled substances
  • Prescription medication sales
Services Involving Minors:
  • Any services involving minors in inappropriate or exploitative ways
  • Content depicting minors in any sexualized context
  • Services that endanger child safety or welfare
Dangerous Items and Activities:
  • Weapons, firearms, explosives, or dangerous materials
  • Illegal drugs or drug paraphernalia
  • Controlled substances without proper authorization
Financial Schemes:
  • Pyramid schemes or multi-level marketing
  • Gambling or betting services (where prohibited by law)
  • Investment schemes promising unrealistic returns
  • Cryptocurrency scams or pump-and-dump schemes
Other Prohibited Services:
  • Services requiring licenses you don't possess
  • Services illegal in your jurisdiction or the client's jurisdiction
  • Services that violate export controls or sanctions
  • Counterfeit goods or trademark violations
  • Hacking, cracking, or unauthorized access services
This list is NOT exhaustive. Pewisty reserves the right to determine what constitutes prohibited activity in our sole discretion.7.4 Consequences of Prohibited ActivitiesViolations may result in:
  • Content removal
  • Account warnings
  • Temporary suspension (7-30 days)
  • Permanent account termination
  • Referral to law enforcement
  • Legal action for damages
We may act immediately for serious violations without prior warning.

8.1 Pewisty's Rights to Suspend or TerminateWe reserve the right to suspend, restrict, or terminate accounts immediately and without prior notice for:
  • Violation of these Terms or any Pewisty policies
  • Illegal activity or suspected criminal conduct
  • Fraud, scams, or deceptive practices
  • Safety concerns or risk to other users
  • Multiple user complaints or disputes
  • Non-payment of subscription fees (Service Providers)
  • Uploading fake, altered, or misleading documents
  • Harassment, abuse, or threatening behavior
  • Manipulation of reviews or platform systems
  • Use of prohibited automation tools
  • Any conduct that harms or threatens Pewisty, its users, or its reputation
  • Suspected security breaches or account compromise
Termination decisions are made at our sole discretion.8.2 Warning System for Service ProvidersFor less severe violations, we may implement a progressive warning system:1st Warning:
  • Notice of policy violation with specific details
  • Opportunity to correct behavior within specified timeframe
  • Temporary content removal if applicable
  • Account remains active
2nd Warning:
  • Formal warning of continued violations
  • Temporary suspension: 7-30 days depending on severity
  • Profile visibility restricted during suspension
  • Final opportunity to comply with Terms
3rd Strike:
  • Permanent account termination
  • No further warnings issued
  • No refund of subscription fees
  • Prohibited from creating new accounts
SERIOUS VIOLATIONS may result in immediate permanent termination without warnings, including but not limited to:
  • Illegal activities
  • Fraud or scams
  • Fake credentials or documents
  • Threats or violence
  • Severe harassment
  • Child safety violations
  • Intentional platform security breaches
8.3 Warning System for Service SeekersService Seekers may also receive warnings or face termination for:
  • Fraudulent activity or payment disputes conducted in bad faith
  • Harassment or abusive behavior toward Service Providers
  • Posting fake reviews or manipulating ratings
  • Attempting to use platform for illegal purposes
  • Multiple complaints from Service Providers
Similar progressive system applies unless violations are severe enough to warrant immediate termination.8.4 Effects of TerminationUpon account suspension or termination:Immediate:
  • Loss of platform access
  • Profile becomes invisible in search results
  • Inability to send or receive messages
  • Suspension of all platform features and services
For Permanent Termination:
  • Profile permanently removed
  • All content and listings deleted
  • Communication history may be retained per our Privacy Policy
  • No refunds for unused subscription time (Service Providers)
  • Outstanding financial obligations remain due
  • Prohibited from creating new accounts or using others' accounts
  • May be banned from future use of Pewisty
Data Retention:
  • Some data retained for legal compliance, dispute resolution, and fraud prevention
  • Retention periods governed by our Privacy Policy
  • You may request data deletion subject to legal retention requirements
8.5 User-Initiated Account ClosureUsers may close their accounts at any time through account settings.Upon voluntary closure:
  • Service Provider subscriptions continue until end of billing period (no refunds)
  • Profile becomes inactive but data may be preserved for [90 days]
  • You may reactivate within [90 days] without data loss
  • After [90 days], account data subject to deletion per Privacy Policy
  • Communication records may be retained longer for dispute documentation
8.6 Appeals ProcessUsers may appeal suspension or termination decisions by:
  • Contacting support@pewisty.com within 30 days of action
  • Providing account information and explanation
  • Submitting any relevant evidence or context
Appeals Process:
  • All appeals reviewed by senior team members
  • Review completed within 10-15 business days
  • Decision communicated via email
  • Appeal decisions are final and binding
  • No further appeals after decision is rendered
We are not obligated to reinstate accounts and decisions are made at our sole discretion.Serious violations (fraud, illegal activity, safety threats) are generally not eligible for appeal and result in permanent termination.

9.1 Platform Provided "AS IS"PEWISTY IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties regarding accuracy, reliability, or availability of the platform
  • Warranties of uninterrupted, timely, secure, or error-free operation
  • Warranties regarding quality or suitability of services offered by users
  • Warranties regarding security of communications or data transmission
  • Warranties regarding results obtained from using the platform
  • Warranties regarding correction of defects or errors
  • Warranties that the platform will meet your requirements
9.2 No Endorsement or VerificationPEWISTY DOES NOT:
  • Endorse, recommend, verify, or guarantee any user, service, or content
  • Conduct background checks, credential verification, or skill assessments
  • Validate licenses, certifications, or professional qualifications
  • Verify accuracy of user profiles, service descriptions, or pricing
  • Assume responsibility for user conduct, service quality, or reliability
  • Guarantee payment, delivery, satisfaction, or any particular outcome
  • Act as agent, representative, or fiduciary for any user
  • Supervise or control services provided between users
Profiles, reviews, and ratings do NOT constitute endorsement or certification by Pewisty.9.3 User Responsibility and Assumption of RiskYOU ACKNOWLEDGE AND AGREE THAT:
  • You are solely responsible for evaluating and selecting Service Providers or Service Seekers
  • You assume ALL risks associated with interactions, transactions, and relationships with other users
  • You are responsible for verifying credentials, licenses, qualifications, and suitability
  • You handle all service agreements, contracts, and payments at your own risk
  • Pewisty has no control over user conduct on or off the platform

Pewisty bears no responsibility for those outcomes.9.4 Limitation of LiabilityTO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PEWISTY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR:Excluded Damages:
  • Any indirect, incidental, special, consequential, punitive, or exemplary damages
  • Loss of profits, revenue, business opportunities, or expected savings
  • Loss of data, goodwill, or reputation
  • Business interruption or lost business
  • Cost of substitute services or products
  • Damages arising from user interactions, disputes, or transactions
  • Damages from service quality, delivery, or non-delivery
  • Damages from payment disputes, non-payment, or fraud
  • Damages from unauthorized access to accounts or data
  • Damages from platform errors, bugs, or technical failures
  • Damages from suspension or termination of accounts
  • Damages from reliance on platform content or user information
This limitation applies to ALL claims, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if:
  • Pewisty has been advised of the possibility of such damages
  • A remedy fails of its essential purpose
  • Damages were foreseeable
Maximum Liability Cap:IN NO EVENT WILL PEWISTY'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE GREATER OF:(a) $100 USD; OR(b) AMOUNTS PAID BY YOU TO PEWISTY IN THE PAST 12 MONTHSThis cap applies in aggregate to all claims and is not per incident.9.5 Basis of the BargainYOU ACKNOWLEDGE THAT:
  • These disclaimers and limitations of liability are fundamental elements of the agreement between you and Pewisty
  • Pewisty would not provide the platform without these limitations
  • These limitations allocate risks between you and Pewisty
  • The limitations reflect a reasonable and fair allocation of risk
  • Your subscription fees and platform access are priced based on these limitations
9.6 Local Law VariationsSome jurisdictions do not allow:
  • Exclusion or limitation of implied warranties
  • Exclusion or limitation of liability for incidental or consequential damages
  • Limitations on duration of implied warranties
In such jurisdictions:
  • Our liability is limited to the greatest extent permitted by law
  • Disclaimers and limitations apply to the maximum extent legally permissible
  • Mandatory consumer protection laws may provide additional rights that cannot be waived
If you are a consumer in the European Union or United Kingdom:
  • Nothing in these Terms limits our liability for death or personal injury caused by our negligence
  • Nothing limits liability for fraud or fraudulent misrepresentation
  • Nothing affects your statutory rights as a consumer

  • We are not responsible for payment disputes between users
  • We do not guarantee payment to Service Providers
  • We do not refund payments made to Service Providers
  • All payment issues must be resolved directly between parties
Service Quality:
  • We do not guarantee service quality, skill level, or professional competence
  • Poor work quality is between Service Provider and Service Seeker
  • We do not provide quality assurance or performance guarantees
Credentials and Qualifications:
  • We do not verify professional licenses, credentials, or certifications
  • Fake or invalid credentials are the responsibility of the user who posted them
  • You must independently verify qualifications before engaging services
Legal Compliance:
  • Users are responsible for ensuring services comply with applicable laws
  • We are not responsible if services offered or requested are illegal
  • Users bear all legal risks associated with their activities

10.1 Your Indemnification ObligationsYou agree to indemnify, defend, and hold harmless Pewisty and its officers, directors, employees, agents, affiliates, licensors, service providers, and contractors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees and court costs) arising from or relating to:Your Use of Platform:
  • Your access to or use of the platform
  • Your violation of these Terms or any Pewisty policies
  • Your violation of any laws, regulations, or third-party rights
  • Your negligence or willful misconduct
Your Content:
  • Content you post, upload, or transmit through the platform
  • Accuracy and legality of your profile information
  • Services you offer or list on the platform
  • Documents, credentials, or certifications you provide
  • Any misrepresentation or fraud in your content
Your Interactions:
  • Your interactions, transactions, or relationships with other users
  • Service agreements, contracts, or arrangements with other users
  • Payment disputes or non-payment issues
  • Quality of services you provide or receive
  • Any disputes with other users
Your Breach:
  • Breach of any representation or warranty in these Terms
  • Infringement of intellectual property or other proprietary rights
  • Defamation, libel, or violation of privacy rights
  • Any injury, damage, or harm caused by your actions
10.2 Defense and SettlementYour indemnification obligations include the duty to:
  • Provide a defense using counsel reasonably acceptable to Pewisty
  • Pay all costs and expenses of defense
  • Pay any settlements or judgments
  • Cooperate with Pewisty in defense of claims
Pewisty reserves the right to:
  • Assume exclusive defense and control of any matter subject to indemnification
  • Require you to cooperate in the defense at your expense
  • Refuse any settlement that does not include unconditional release of all liability
10.3 SurvivalThis indemnification obligation:
  • Survives termination of your account
  • Survives termination or expiration of these Terms
  • Continues indefinitely for claims arising from your use of the platform

11.1 Third-Party Content and LinksPewisty may contain links to or integrations with third-party websites, services, resources, or content, including:
  • Social login providers (Google, Apple, Microsoft)
  • Payment processors for verification
  • Service Provider external websites or portfolios
  • Educational resources or blog content
  • Social media platforms
  • Analytics and advertising services
11.2 No Control or ResponsibilityWe do NOT control, endorse, sponsor, recommend, or assume responsibility for:
  • Content, products, or services of third parties
  • Privacy policies or data practices of third parties
  • Accuracy, legality, or appropriateness of third-party content
  • Transactions or interactions with third parties
  • Security of third-party websites or services
  • Quality or reliability of third-party offerings
  • Damages or losses arising from third-party interactions
11.3 Your Use of Third-Party ServicesWhen you access third-party services:
  • You leave Pewisty's platform and control
  • You are subject to the third party's terms of service and privacy policy
  • You should review their policies before proceeding
  • You engage at your own risk
  • Any issues must be resolved directly with the third party

  • Limit your rights
  • Disclaim warranties and limit liability

13.1 Informal Resolution FirstBEFORE FILING ANY FORMAL CLAIM, you agree to contact us at legal@pewisty.com to attempt informal resolution of any dispute, claim, or controversy.We will attempt to resolve disputes through good faith negotiation for at least 30 days before either party may commence arbitration or litigation.This informal resolution requirement is a condition precedent to filing any claim.13.2 Binding Arbitration AgreementPLEASE READ CAREFULLY: This arbitration provision affects your legal rights, including your right to file a lawsuit in court.If informal resolution fails, you agree that any dispute, claim, or controversy arising out of or relating to:
  • These Terms or their breach, termination, enforcement, interpretation, or validity
  • Your access to or use of the platform
  • Any services or transactions facilitated through the platform
  • Your relationship with Pewisty
  • Privacy practices or data handling
  • Account suspension or termination
  • Any other aspect of your relationship with Pewisty

Costs and Fees:
  • Each party bears own attorneys' fees and costs unless arbitrator awards otherwise

  • Arbitration fees split according to provider's rules for claims over $10,000
  • Arbitrator may award attorneys' fees and costs to prevailing party if authorized by law
13.4 Arbitrator's Authority and DecisionThe arbitrator has authority to:
  • Grant any relief that would be available in court
  • Award monetary damages and other relief
  • Issue injunctive or declaratory relief
  • Award attorneys' fees and costs if permitted by law
  • Resolve threshold issues including arbitrability, statute of limitations, and formation defenses
The arbitrator does NOT have authority to:
  • Award relief beyond the individual parties' dispute
  • Award punitive or exemplary damages unless statute provides otherwise
  • Consolidate claims or conduct class proceedings
Arbitrator's Decision:
  • Final and binding on the parties
  • Enforceable in any court with jurisdiction
  • Subject to very limited review under applicable law
  • Not precedential and has no preclusive effect in other arbitrations or proceedings
13.5 CLASS ACTION WAIVERYOU AND PEWISTY AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY.YOU WAIVE ANY RIGHT TO:
  • Participate in or bring class action lawsuits
  • Participate in or bring class arbitrations
  • Join or consolidate claims with other users
  • Serve as class representative or class member
  • Participate in representative proceedings under Private Attorneys General Acts or similar statutes
EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.The arbitrator may not consolidate multiple parties' claims and may not preside over any form of class or representative proceeding.If this class action waiver is found to be unenforceable for any reason, the entire arbitration agreement (but not these Terms) will be void, and the dispute must be brought in court.13.6 Exceptions to ArbitrationEither party may pursue the following in court instead of arbitration:Small Claims Court:
  • Claims within the jurisdictional limit of small claims court
  • Must be brought on individual basis, not as class action
  • Either party may remove to arbitration if claim exceeds small claims limits
Intellectual Property Claims:
  • Claims of trademark, patent, or copyright infringement
  • Claims seeking injunctive relief for intellectual property violations
Injunctive Relief:
  • Either party may seek temporary or preliminary injunctive relief in court
  • Pending arbitration or to preserve status quo
  • Does not waive right to arbitrate underlying dispute
Emergency Relief:
  • Either party may seek emergency relief in court if necessary to prevent irreparable harm
  • Such relief does not waive arbitration agreement
13.7 Opt-Out RightYou have the right to opt out of this arbitration agreement.To opt out, you must:
  • Send written notice to legal@pewisty.com
  • Within 30 days of first accepting these Terms (account creation or first use)
  • Include: your full name, email address, and clear statement that you wish to opt out of the arbitration agreement
  • Use subject line: "Arbitration Opt-Out"
If you opt out:
  • This arbitration agreement will not apply to you
  • Disputes will be resolved in court as provided in Section 14 (Governing Law)
  • All other Terms remain in effect
  • Opt-out applies only to arbitration, not class action waiver (if enforceable separately)
Opt-out is permanent and cannot be rescinded.13.8 Changes to Arbitration TermsIf we make material changes to this arbitration section:
  • Changes do not apply to pending disputes
  • You may reject changes by opting out within 30 days of notice
  • Continued use after 30 days constitutes acceptance
13.9 Severability of Arbitration ProvisionsIf any portion of this arbitration section is found to be unenforceable:
  • The remainder of this arbitration section remains in effect
  • Exception: If class action waiver is unenforceable, entire arbitration agreement is void
  • Unenforceable provisions severed to minimum extent necessary
13.10 Disputes Between UsersIMPORTANT: This arbitration agreement applies ONLY to disputes between YOU and PEWISTY.Disputes between Service Providers and Service Seekers:
  • Are NOT subject to this arbitration agreement
  • Must be resolved directly between the users involved
  • Pewisty is not a party to such disputes
  • Users may pursue their own legal remedies against each other
  • Pewisty may provide communication records if requested but does not participate in resolution
While we may provide communication records and dispute assistance for digital services, WE DO NOT mediate, arbitrate, or resolve user-to-user disputes.

Where local mandatory consumer protection laws provide greater protection than these Terms, such mandatory provisions will apply to the extent required by law.14.4 Specific Jurisdictional ProvisionsTurkiye Users:
  • These Terms do not override mandatory consumer protection provisions under Turkish law
  • Turkish Competition Authority and consumer protection regulations apply where required
  • Disputes may be subject to Turkish Consumer Arbitration Committees where applicable by law
European Union Users:
  • Nothing in these Terms affects your statutory rights under EU consumer protection law
  • EU Directive 2013/11/EU on Alternative Dispute Resolution may apply
  • EU Regulation 524/2013 on Online Dispute Resolution may apply
  • Platform for Online Dispute Resolution: https://ec.europa.eu/consumers/odr
United Kingdom Users:
  • Your statutory rights under UK consumer protection law are not affected
  • Alternative Dispute Resolution and Online Dispute Resolution provisions apply where required

15.1 Modifications to TermsWe reserve the right to modify, amend, or update these Terms at any time.When we make changes:
  • We will update the "Last Updated" date at the top
  • Material changes will be communicated via:
    • Email notification to your registered email address
    • Prominent notice on the platform (banner, popup, or notification)
    • In-app notification for mobile users
What Constitutes "Material Changes":
  • Changes to fees or payment terms
  • Changes to arbitration or dispute resolution provisions
  • Expanded limitations of liability or disclaimers
  • New restrictions on platform use
  • Changes to subscription terms or cancellation policies
  • Significant changes to user rights or obligations
Acceptance of Changes:
  • Continued use after changes become effective constitutes acceptance
  • If you do not agree with changes, you must stop using the platform and close your account
  • For material changes, we may require active acceptance before continued use
Your Options:
  • Accept changes and continue using platform
  • Close your account before changes take effect
  • For arbitration changes: opt out within 30 days per Section 13.8
15.2 SeverabilityIf any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or arbitrator:
  • That provision will be limited or eliminated to the minimum extent necessary
  • The remaining provisions will remain in full force and effect
  • Invalid provisions will be replaced with valid provisions that most closely match the intent
  • Unenforceability in one jurisdiction does not affect enforceability in others
Exception: If the class action waiver in Section 13.5 is found unenforceable, the entire arbitration agreement (Section 13) will be void, but all other Terms remain enforceable.15.3 WaiverFailure or delay by Pewisty to enforce any right or provision of these Terms does NOT constitute:
  • A waiver of that right or provision
  • A waiver of any other right or provision
  • A waiver of future enforcement
Any waiver must be:
  • In writing
  • Signed by an authorized representative of Pewisty
  • Specific as to the right or provision being waived
No single or partial exercise of any right prevents further exercise of that right or any other right.15.4 Assignment and TransferYou may NOT:
  • Assign or transfer these Terms or your account to any third party
  • Delegate your obligations under these Terms
  • Transfer your rights without our prior written consent
Any attempted assignment or transfer in violation of this provision is void.Pewisty may:
  • Assign or transfer these Terms without restriction
  • Transfer our rights and obligations to affiliates, subsidiaries, or third parties
  • Assign in connection with merger, acquisition, or sale of assets
Assignment does not relieve Pewisty of obligations to you under these Terms and Privacy Policy.15.5 Entire AgreementThese Terms, together with:
  • Our Privacy Policy
  • Any other policies or guidelines referenced herein
  • Any additional terms accepted for specific features
Constitute the ENTIRE agreement between you and Pewisty regarding the platform and supersede all prior or contemporaneous:
  • Agreements, understandings, or communications
  • Representations or warranties
  • Proposals or negotiations
If there is any conflict between these Terms and other documents:
  • These Terms control unless specifically stated otherwise
  • Additional terms for specific features supplement but do not replace these Terms
15.6 SurvivalThe following provisions survive termination or expiration of these Terms or your account:
  • Fees and Payments (Section 5) - for amounts owed
  • Intellectual Property (Section 6) - licenses granted and ownership
  • Prohibited Activities (Section 7) - for violations prior to termination
  • Disclaimers and Limitation of Liability (Section 9)
  • Indemnification (Section 10)
  • Dispute Resolution and Arbitration (Section 13)
  • Governing Law (Section 14)
  • General Provisions (Section 15) - to the extent necessary
Any provision that by its nature should survive termination will survive, including but not limited to provisions regarding:
  • Ownership and intellectual property
  • Dispute resolution procedures
  • Liability limitations and disclaimers
  • Indemnification obligations
15.7 No Agency or PartnershipNothing in these Terms creates:
  • A partnership, joint venture, or agency relationship between you and Pewisty
  • A partnership, joint venture, or agency relationship between users
  • An employment relationship between you and Pewisty
  • A fiduciary duty owed by Pewisty to you
You acknowledge that:
  • You are an independent party
  • Service Providers are independent contractors, not employees
  • Pewisty does not supervise, direct, or control users' activities
  • Users are solely responsible for their own business relationships
Neither you nor Pewisty has authority to:
  • Bind the other to any obligation
  • Make representations on behalf of the other
  • Incur liabilities on behalf of the other
15.8 Force MajeurePewisty is not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to:
  • Acts of God (earthquakes, floods, hurricanes, natural disasters)
  • War, terrorism, civil unrest, or insurrection
  • Government actions, laws, regulations, or embargoes
  • Pandemics, epidemics, or public health emergencies
  • Labor disputes, strikes, or lockouts
  • Internet failures, telecommunications outages, or infrastructure failures
  • Power outages or equipment failures
  • Cyberattacks, hacking, or denial of service attacks
  • Third-party service provider failures
  • Acts or omissions of third parties
During force majeure events:
  • Obligations are suspended to the extent affected
  • We will use reasonable efforts to resume performance
  • We will notify users of significant disruptions when practicable
  • No refunds or credits owed for service disruption
If force majeure continues for more than 30 days, either party may terminate the agreement without liability (except for amounts owed prior to termination).15.9 Language and TranslationThese Terms are drafted in English.If we provide translations:
  • Translations are for convenience only
  • In case of conflict between versions, the English version prevails
  • English version is the legally binding version
  • You are responsible for understanding the English version
If you do not understand any provision, seek independent legal advice before accepting these Terms.15.10 InterpretationIn interpreting these Terms:
  • Headings are for reference only and do not affect interpretation
  • "Including" means "including but not limited to"
  • Singular includes plural and vice versa
  • "Or" is not exclusive (A or B means A, B, or both)
  • "Will" and "shall" are equivalent and indicate mandatory obligations
  • "May" indicates discretionary rights

15.11 Electronic CommunicationsYou consent to receive communications from us electronically, including:

  • In-app notifications
  • Messages through platform messaging system
Electronic communications satisfy any legal requirement for written communications.You agree that:
  • Electronic records constitute original records
  • Electronic signatures are legally binding
  • You can access and retain electronic communications
  • You will maintain a valid email address
15.12 Notice RequirementsNotices to Pewisty must be sent to:

  • Include: your full name, account email, and detailed description
Notices to you will be sent to:
  • Your registered email address
  • In-app notifications or platform announcements
Notices are effective:
  • Email: When sent to your registered address (whether or not read)

  • Mail: When deposited with postal service (if applicable)
You must maintain current contact information in your account.15.13 US Government UsersIf you are a U.S. government entity or using the platform on behalf of a U.S. government entity:
  • The platform is a "Commercial Item" as defined in 48 C.F.R. § 2.101
  • Commercial Computer Software and documentation per 48 C.F.R. § 12.212 or 48 C.F.R. § 227.7202
  • Use, duplication, and disclosure subject to these Terms
  • No additional rights granted beyond these Terms
15.14 Export ControlsYou agree to comply with all applicable export and import laws and regulations.You represent that you are not:
  • Located in, or a national of, any country subject to U.S. embargo
  • Listed on any U.S. government prohibited or restricted party list
  • Subject to export restrictions under applicable law
You will not use the platform:
  • In violation of export laws or regulations
  • To export or re-export data or services in violation of law
  • For any prohibited end use (nuclear, chemical, biological weapons)
Violation may result in immediate account termination.15.15 Relationship to Other AgreementsIf you have entered into a separate written agreement with Pewisty:
  • That agreement controls to the extent of any conflict
  • These Terms apply to matters not covered by the separate agreement
  • Both agreements remain in effect unless explicitly superseded
15.16 Third-Party BeneficiariesThese Terms do not confer any rights or remedies on any third parties, except:
  • Pewisty's officers, directors, employees, agents, and affiliates are third-party beneficiaries of provisions limiting liability and requiring indemnification
  • Payment processors and service providers are third-party beneficiaries of relevant limitation and indemnification provisions
No other persons or entities are third-party beneficiaries.15.17 Cumulative RemediesRights and remedies under these Terms are:
  • Cumulative, not exclusive
  • In addition to any other rights or remedies available at law or in equity
  • May be exercised concurrently or separately
Exercise of one remedy does not preclude exercise of other remedies.
